Assumption of Risk & Liability Waiver

 

By booking and using the Canine Field of Dreams Private Dog Park, I acknowledge that I have read, understood, and agree to the following terms:

1. Assumption of Risk

 

I understand that activities involving dogs and outdoor recreation involve inherent risks, including but not limited to bites, scratches, falls, collisions, escape, injury, illness, property damage, and death to people or animals. I voluntarily assume all risks associated with my use of the property and participation in any activities.

2. Responsibility for My Dog(s)

 

I certify that:

 

I certify that my dog(s) are healthy, free of known contagious illness, and legally vaccinated as required by applicable law. I will not bring a dog onto the property that is showing signs of contagious illness.

3. Aggressive or Dangerous Behavior

 

I agree not to bring any dog with a known history of aggression toward people.

 

If my dog displays unsafe, aggressive, or uncontrollable behavior, I will immediately leash my dog and leave the property if necessary.

4. Children

 

Children are welcome but must remain under the direct supervision of an adult at all times.

 

Parents and guardians accept full responsibility for their children’s safety and behavior while on the property.

5. Property Rules

 

I agree to:

 

* Keep all dogs leashed until safely inside the play field and immediately after exiting.

* Ensure all gates are securely closed and latched behind me.

* Pick up after my dog(s) and dispose of waste properly.

* Remove all toys, treats, and personal belongings before leaving.

* Respect my reservation time by arriving and leaving promptly.

* Wait until the previous guest has completely exited the field before entering.

* Follow all posted rules, signs, and instructions.

I will not enter a Play Field before my scheduled reservation time and will completely exit the Play Field by the end of my scheduled reservation.

6. Agility Equipment & Amenities

 

Use of agility equipment, natural obstacles, pools, sand areas, benches, and all other amenities is voluntary and entirely at my own risk.

 

I understand these features may present hazards and agree to appropriately supervise my dog(s), children, and guests at all times.

7. Natural Environment

 

I understand that the Private Play Fields are natural outdoor environments.

 

Potential hazards include, but are not limited to:

 

* Uneven ground

* Mud

* Holes

* Rocks

* Tree roots

* Branches

* Standing water

* Wildlife

* Insects

* Snakes

* Weather conditions

* Other natural obstacles

 

I voluntarily assume all risks associated with these conditions.

8. Camera Monitoring

 

I understand that the Private Play Fields are monitored by security cameras for the safety and security of guests, their dogs, staff, and the property.

 

Video recordings may be reviewed in the event of an accident, emergency, property damage, policy violation, or for business purposes.

 

By entering the property, I consent to video recording. Audio recording is not guaranteed.

9. Property Damage

 

I agree to be financially responsible for any damage caused by me, my guests, or my dog(s) beyond normal wear and tear.

10. Emergency Care

 

In the event of an emergency, I am responsible for obtaining appropriate medical or veterinary care for myself, my guests, children, and dog(s), and I am responsible for all resulting expenses.

11. Cancellation Policy

 

Reservations canceled at least twenty-four (24) hours before the scheduled session will receive a full refund.

 

Reservations canceled less than twenty-four (24) hours before the scheduled session are non-refundable.

12. Guests

I am responsible for all people and dogs I bring onto the property. I will ensure that my guests comply with these Rules and Waiver, and I accept responsibility for their actions while on the property.

13. Right to Refuse Service

 

Canine Field of Dreams reserves the right to refuse or terminate access to the Private Play Fields, without refund, for:

 

* Unsafe behavior

* Failure to follow posted rules

* Aggressive behavior toward people

* Vandalism

* Misuse of the property

* Violation of this Agreement

14. Release of Liability

 

To the fullest extent permitted by law, I release, waive, and hold harmless Canine Field of Dreams LLC, its owners, employees, agents, contractors, and representatives from any and all claims, liabilities, damages, losses, costs, or expenses arising from or related to my use of the Private Play Fields.

 

This includes, but is not limited to:

 

* Injury or death of myself, my children, guests, or dog(s)

* Injury to another person or animal caused by my dog(s)

* Property damage

* Veterinary expenses

* Medical expenses

* Loss of personal property

 

except where prohibited by applicable law.

15. Indemnification

 

I agree to defend, indemnify, and hold harmless Canine Field of Dreams LLC, its owners, employees, agents, and representatives from any claims, damages, liabilities, costs, or expenses, including reasonable attorney’s fees, arising out of my use of the property or the actions of myself, my guests, children, or dog(s).

16. Governing Law

 

This Agreement shall be governed by and interpreted according to the laws of the State of Nebraska.

17. Severability

 

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Agreement

 

I certify that I have carefully read this Assumption of Risk and Liability Waiver in its entirety, fully understand its contents, and voluntarily agree to all of its terms and conditions.

 

By checking the required agreement box during booking and completing my reservation, I acknowledge that I have read, understand, and voluntarily agree to this Assumption of Risk, Rules and Liability Waiver. I understand that this Agreement affects my legal rights.

This Agreement applies to my current reservation and all subsequent visits to the Canine Field of Dreams Private Play Fields unless replaced by a newer version.

 

This Agreement applies to every visit to the Canine Field of Dreams Private Dog Park unless replaced by a newer version.
